THIS NOTICE DESCRIBES HOW MEDICAL AND OTHER PERSONAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.
We at Lemur Finance, LLC. ("Lemur", "us", "we", or "our") recognize and respect the importance of maintaining the privacy of our customers and users. This Privacy Notice describes the types of personal and protected health information we collect from patients or customers of participating merchants, such as clinics ("Merchants") using our web-based platform ("Platform") and/or services available thereon ("Services") and how we may use and share such information. "Personal information" means any information that can be directly associated with a specific person such as a name, telephone number, e-mail address or as otherwise may be defined by applicable law. "Protected health information" means individually identifiable information about your health, such as any information about (i) your health condition, (ii) healthcare services you have received or may receive in the future, or (iii) the payment for the provision of such healthcare when combined with additional information which may identify you (such as your name, phone number or Social Security Number).
Information We Collect
It is your voluntary decision whether to provide us with any such information, but if you refuse to provide such information, you may not be able to use the Platform and/or Services to find you a Financing Solution. In order to find a Financing Solution through the Platform, you must provide certain personal and protected health information. There are four main types of information collected: Personal identifiers, such as your name, date of birth, (mobile) phone number, email address, and social security number. General information relevant to the Application, such as your annual income, the state in which you are located, and your employment status. Information about the treatment or other services for which you are requesting a Financing Solution, such as the cost of the applicable treatment/services and desired terms for the requested Financing Solution, and, in some cases, the date of the treatment. Payment information, such as your credit card or bank information.You may also elect to provide additional information, as may be requested by us. If you are submitting an Application in respect of a Third-Party, you may need to provide us with certain protected health information relating to such an individual, such as his or her name and information regarding the treatment received by such Third-Party. In addition, Financing Institutions may provide us with personal information about you. Subject to applicable law, we also collect and create certain de-identified information about you and your use of the Platform and/or Services, including, relating to your or Third-Party's treatment or services received from the applicable Merchant, income, housing status, payment dates, Financing Solutions offered and received through the Services, and your preferences and selections on the Platform and/or Services ("De-Identified Information"). De-Identified Information does not individually identify you.
How We Use Your Information
We and any of our trusted third-party subcontractors and service providers use the information we collect from and about you solely to provide you with the Services. To do so, we transmit the personal and protected health information you provide to us to Financing Institutions offering Financing Solutions through the Platform and/or Services. We or the applicable Financing Institutions may also use such information to obtain credit reports about you from consumer reporting agencies, at their sole discretion. In addition, Merchants will have access to information regarding your Application and the Financing Solution. We may use De-Identified Information about you (i) to review the usage and operations of our Platform and Services, (ii) to develop new products or services and conduct analyses to improve our current products and services, (iii) to prevent fraud, protect the security of our Platform and Services, and address any problems with the Platform and/or Services, and (iv) for such other purposes permitted by applicable law and in accordance with our agreement with the applicable Merchant. Other uses by Lemur of your protected health information not described above in this Privacy Notice or permitted by law will be made only with your written authorization.
Sharing the Information We Collect
We share your information, including personal and protected health information, as follows: Merchants Certain personal information will be provided to the Merchants, such as information regarding the status of your Application and the Financing Solution, and whether the Financing Solution has been granted and the terms thereof. You acknowledge and agree that any relevant Merchant may send you notifications, notices, disclosures, and other communications, including by SMS, in connection with the Services. If you wish to opt out of your consent hereby granted, please contact us at contact@lemurfinance.com and please contact the relevant Merchant. Financing Institutions We disclose information, including personal and protected health information we collect from and/or about you, to Financing Institutions for the purpose of finding you a Financing Solution. Use of your personal and protected health information shall be in accordance with such Financing Institution's terms and privacy policy. Service Providers, Affiliates, and Subcontractors We disclose information, including personal and protected health information we collect from and/or about you, to our trusted service providers, affiliates, and subcontractors, who use such information to help us provide the Platform and/or Services. Law Enforcement Related Disclosure We will fully cooperate with any law enforcement authorities or court order requesting or directing us to disclose your personal and protected health information as required or authorized by applicable law. We may also share your personal and protected health information with third parties (i) when required by law, regulation, subpoena, court order, discovery request, warrant, summons or other lawful instructions from a court or other administrative or public body, (ii) as is necessary to comply with any legal and/or regulatory obligation, subject to applicable law. Other disclosures by Lemur of your personal and protected health information not described above in this Privacy Notice or permitted by law will be made only with your written authorization.
Your Rights
You have certain rights under applicable law in relation to your protected health information such as (i) the right to obtain a copy of your protected health information, (ii) the right to amend your protected health information, (iii) the right to request to limit the use or disclosure of your protected health information, (iv) the right to request an accounting of disclosures of your protected health information; and (v) the right to file a complaint if you feel your privacy rights have been violated. Security
We make efforts to follow generally accepted industry standards to protect the personal and protected health information submitted to and transmitted by us. However, no method of transmission over the Internet or method of electronic storage is 100% secure. Therefore, while we strive to use commercially acceptable means to protect your personal and protected health information, we cannot guarantee its absolute security. Data Retention Subject to applicable law, we retain personal information and personal health information as necessary for the purposes set forth above, all in accordance with our data retention policies. We may delete information from our systems without notice to you once we deem it is no longer necessary for these purposes. We may store your personal information and personal health information for longer than the period of provision of services, where we are required to do so in accordance with legal, regulatory, tax, audit, accounting requirements and so that we have an accurate record of your dealings with us in the event of any complaints or challenges, or if we reasonably believe there is a prospect of litigation relating to your information or dealings.

Before providing any personal and/or protected health information, you shall be asked to accept the terms of this Privacy Notice. If you do not agree with the terms hereof, please do not provide any such information or use the Platform. We may update this Privacy Notice from time to time, to keep it up to date with legal requirements and the way we operate our business, and we will place any updates on this webpage.
